I, Timothy McVeigh, the defendant in this action, have been advised by my court appointed counsel that Mr. Paul Looney and/or Mr. Brent Liedtke have made statements concerning their purported representation of me in this case. I met with Messrs. Looney and Liedtke, briefly, during the morning of April 27, 1995, and I advised them that I did not desire their representation.

Any statemnts made by Messrs. Looney and Liedtke to the contrary are false and unathorized. I do not now, nor did I ever, desire their representation in this matter.

ORDER

Before the Court are notices of appearance and a motion to appear pro hac vice by Paul C. Looney & Associates and J. Brent Liedtke of Houston, Texas, who have tendered their appearances as privately retained counsel for the Defendant. On April 27, 1995, a combined preliminary examination and detention hearing was conducted concluding with findings of probable cause for holding the Defendant for further proceedings in district court and an Order of Detention was also entered. Defendant is charged with a death penalty offense for maliciously damaging and destroying the Alfred P. Murrah Federal Building in Oklahoma City, Oklahoma, resulting in death to one or more persons. 18 U.S.C. 844(f). At the conclusion of this hearing, the Defendant confirmed his desire, first expressed at the initial appearance on April 21, 1995, to be represented by court-appointed counsel. In addition, the Defendant has filed an "Advisement to the Court" stating that he does not desire the representation of Messrs Looney and Liedtke.

Accordingly, in keeping with the discretion accorded to the Court under Local Court Rule 4, the motion to appear pro hac vice is overruled, the notices of appearances by Paul Looney, Paul Looney & Associates and J. Brent Liedtke are stricken, and Defendant will be represented exclusively by counsel appointed by the Court.

It is further ORDERED that in consideration of motions to withdraw that are reurged by John W. Coyle and Susan M. Otto that said motions are sustained and they will not further represent the Defendant except to effect an orderly transition of the defense to substitute counsel.

It is further ORDERED that Stephen Jones, attorney at law, of Enid, Oklahoma, is hereby appointed to represent the Defendant at all further proceedings unless otherwise ordered by the Court in accordance with the provisions of 18 U.S.C. 3005, 3006A.

PLEASE TAKE NOTICE that the Notice of Appearance filed on April 27, 1995 by Paul C. Looney and J. Brent Liedtke, of Paul Looney & Associates of Houston, Texas, in the above-entitled and numbered cause, are hereby withdrawn. The withdrawal of appearance notices is predicated upon the United States Magistrate Judge Ronald L. Howland's advice and consent communicated to counsel on May 4, 1995, by conference telephone call between the offices of Paul C. Looney & Associates representative, J. Brent Liedtke, United States Magistrate Judge Ronald L. Howland and El Reno, Oklahoma FCI Warden, Ron Thompson.
