Applicant, XXXX, declares as follows:
1. Applicant acted in Pro Per in the trial court and acts in Pro Per in this appeal.
2. Applicant's notice of appeal was filed on May 4, 1995 with the Clerk of the Superior Court of Orange County, Family Law Division.
3. Applicant received a Notice of Default May 18, 1995. Applicant has moved the Court for Relief from Default. As stated in the Motion, the Applicant has had two of his four children sick with the flu. He has also experienced difficulty in obtaining a viewing of the court clerk's file record for inventory.
4. Applicant has been assured by the deputy clerk that the file will be available for viewing Friday, May 26, 1995. Applicant will obtain all needed information to prepare a combined notice to prepare reporter's transcript and designation of record.
5. Applicant knows of no harm which will accrue to the respondent from an extension of time to file the heretofore mentioned notice.
6. There have been no previous applications granted or denied to any party after filing of the notice of appeal.
7. Based on the above facts, Applicant submits that it would be just and proper to order that the time for filing the mentioned notice be extended to June 3, 1995, and Applicant respectfully prays for an order to that effect.
